History of Hill Country Village

Hill Country Village in Texas is a rural incorporated suburb just two miles north of San Antonio. Hill Country Village started out as a pig farm run by Clyde Stevens, but after World War II ended developers Meliff, Todd, and Hill Country Water Works began developing the first suburb north of San Antonio. At that time, 9-acre tracts of land were sold to those who wanted to live with plenty of space near the San Antonio area. As San Antonio and Bexar County continued to expand, citizens who wanted to maintain some independence voted to incorporate Hill Country Village in 1956.

What Is A Wrongful Death in Texas?

Unfortunately, even in a rural place like Hill Country Village, accidents happen. Wrongful deaths are possible in Hill Country Village as in any other area of the world.

According to the Texas Civil Practice and Remedies Code, Title 4, Chapter 71, Subsection A, wrongful death is defined as a death that is caused by another person’s “wrongful act, neglect, carelessness, unskillfulness, or default.” In a wrongful death case, the surviving family members such as spouses, parents, or children may file suit against the person who caused the wrongful death. Some common examples of wrongful death incidences include:

  • Car accidents, especially those caused by drunk drivers
  • Motorcycle accidents
  • Medical malpractice situations
  • Slip and fall cases
  • Truck accidents
  • Product liability incidents
  • Nursing home neglect
  • Nursing home abuse

In a wrongful death case, Texas law states that “The jury may award damages in an amount proportionate to the injury resulting from the death.” The injury that qualifies for damages could include emotional distress, loss of relationship, loss of income, loss of inheritance, funeral costs, and medical treatment that may have been provided to the person before their death. A Bexar County personal injury attorney will be able to provide further information on just what damages can be awarded in a wrongful death case.

Proving Negligence in a Wrongful Death Case near Hill Country Village

If you’ve been involved in a wrongful death case near Hill Country Village, Texas, you are not alone. Dealing with death is hard enough without having to worry about proving negligence. A wrongful death attorney will tell you there are basic steps to proving that someone was negligent in a wrongful death case. These are:

  1. Prove that the defendant had some duty of care to the person killed. This could include any reasonable care that a person should have taken to protect another from death. It could be anything from an employer who should have provided better equipment to a driver who should have refused to drive when under the influence of alcohol or drugs.
  1. Prove that the defendant breached their duty of care by acting recklessly.
  1. Prove that the defendant’s careless acts were the cause of death.
  1. Prove that the death was caused by the negligent actions of the defendant.

How Long It Takes To Settle A Wrongful Death Suit

In Texas, you must file a wrongful death suit within two years. Once you have filed, it can take anywhere from one to four years to settle. This is dependent on many factors, such as the gathering of evidence, any police investigations, whether you can work out a mediated settlement, the extent of litigation if the case does go to court, and the skill of your Texas wrongful death lawyer. While many of these factors are out of your control, you should do your best to find an attorney who has experience and truly cares about helping you. It’s never easy to lose a loved one, but the right lawyer will do everything in their power to ease the pain by getting you justice.
