How do you prove the other driver was distracted?

We investigate using cell phone records, vehicle event data recorders (black boxes), traffic camera footage, dashcam recordings, witness statements, and police reports. In many cases, phone records alone can show the driver was texting or using their phone at the moment of impact.

Yes. Since September 1, 2017, it has been illegal to read, write, or send text messages while driving in Texas. Violators face fines up to $200. While the law helps, enforcement is difficult, and distracted driving remains one of the leading causes of accidents in the state.
